The short answer

Sarasota County's Official Records is the biggest probate feed we follow in Florida: 3,069 probate documents dated Feb 6, 2026 to Oct 23, 2026, with 460 in the last 30 days. If you are trying to understand where a Sarasota estate stands, the document type tells you the stage, and the types here are unusually clear.

What each Sarasota document type means for the house

  • Order (1,807): a court order recorded by the clerk. Reading the clerk's description, 480 of these are discharges. A discharge ends a personal representative's role after the estate is closed, so it signals an estate that is finished, not one that is starting.
  • Letters (658): letters of administration. This is the document that proves who may act for the estate, including who may sign a deed. It is the one a title company asks for first.
  • Will (498): a will recorded after the court admitted it to probate.
  • Petitions (57 for administration and 23 for summary administration): the filing that opens an estate. Summary administration, under section 735.201 of the Florida Statutes, is the shorter route for small estates.

Put together, orders, letters and wills far outnumber petitions, because a petition is one document and an open estate often records several others after it. That is the practical reason we count documents and not estates.

How many tie to a Sarasota address

Only 538 of the 3,069 documents (18%) resolve to a street address, because the Sarasota index records the decedent and the case number but often no property. Where an address is there, the places are Sarasota (258), Venice (120), North Port (91), Englewood (32), Nokomis (22), Longboat Key (9). The index also records the clerk's own case reference, such as a '2025 CP' number, where 'CP' is the circuit court's probate division.

Recording days differ from Polk's. Sarasota documents land on 829 Fridays, 729 Mondays, 710 Thursdays, 472 Tuesdays and 329 Wednesdays, and 0 on weekends.

Selling an inherited house in Sarasota County

Sarasota is in the Twelfth Judicial Circuit, with Manatee and DeSoto counties, and probate is filed with the Sarasota County Clerk of the Circuit Court. Chapter 733 of the Florida Statutes governs administration, and section 733.612 gives a personal representative the power to sell estate real property. Chapter 732 decides who inherits when there is no will.

  1. Confirm in the clerk's records which of the document types above has been recorded for your family member.
  2. If letters have been issued, the personal representative can sign a contract. If only a petition is recorded, the court has not yet named anyone.
  3. Ask the Sarasota County Tax Collector what is owed on the parcel, which is common to find behind on a house nobody is living in.
  4. Close through a title company or attorney. Mortgage payoff, liens and back taxes come out of the proceeds and the rest goes to the estate.

Sarasota's coastal condos and its older inland houses are sold as-is the same way. The statewide steps are in selling a house in probate in Florida, and other counties' numbers are in Florida probate filings by county.

How many Sarasota County probate documents are in your records?
3,069 documents recorded in the Sarasota County Official Records between Feb 6, 2026 and Oct 23, 2026, as of Oct 27, 2026. They are documents and not estates, so one estate can appear more than once.
Does a discharge order mean the estate is still open?
No. A discharge ends the personal representative's role once the estate is closed. In our Sarasota records 480 of 1,807 order documents are described as discharges.
What document proves who can sign a deed for a Sarasota estate?
The letters of administration, issued by the court. A title company will ask for certified copies of the letters and the death certificate before closing. A Florida attorney can confirm what your estate needs.
